Terms of Use
Last updated: 28 October 2026
These terms are an agreement between you and Emerald Lion Technologies Ltd, the company that makes Rosie. Please read them: by creating an account or using Rosie, you agree to them. Our Privacy Policy explains how we handle your data.
1. Who we are
Rosie is provided by Emerald Lion Technologies Ltd, registered in Wyoming, USA, with its registered office at 30 N Gould St, Suite 31683, Sheridan, WY 82801, USA ("we", "us"). Contact: hello@askrosie.app.
2. Age and responsible drinking
- Rosie is about alcohol. You must be of legal drinking age where you live to use it: at least 18, and 21 in the United States.
- Rosie helps you choose a wine you'll enjoy; it doesn't encourage you to drink more. Please drink responsibly, never drive after drinking, and don't drink alcohol if you're pregnant, taking medication that doesn't mix with alcohol, or have been advised not to.
- Rosie doesn't know about allergies, intolerances or health conditions (for example sulphites). Always check with the restaurant.
3. What Rosie does, and its limits
You photograph a restaurant's wine list, answer a few questions, and Rosie suggests a wine and a backup, explains why, and answers questions about the wines on that list. To do this, Rosie uses automated reading and artificial intelligence (AI).
- Suggestions, not guarantees. Rosie's suggestions are for information and enjoyment. Taste is personal, and we can't promise you'll like a wine.
- Rosie can make mistakes. It can misread a list (a name, vintage or price) or say something inaccurate about a wine. Always check the name, vintage and price with the restaurant before ordering. The restaurant's list and staff are what count.
- Prices and availability are the restaurant's. Rosie doesn't sell wine, take orders or receive anything from restaurants or producers for its suggestions.
- Rosie is a wine-list companion, not a wine database: it works with the list you scan.
4. Your account
- You sign in with Apple or Google. Keep access to that account secure; you're responsible for what happens in Rosie under your account.
- An account is for one person. Give us accurate information, and don't create accounts to get around limits.
- You can delete your account at any time in the app (Profile → Delete account).
5. Free scans, Rosie Plus and Rosie Grand Cru
- Rosie Free includes a number of free scans: currently 4 in your first 30 days, then 2 each month, counted from the day you created your account. A scan counts only when Rosie gives you a recommendation. Unused scans don't carry over. The app shows how many you have left and when more arrive.
- Rosie Plus is a paid subscription with unlimited scans for personal use, subject to fair use (section 7). Currently, scanning is the only difference between Rosie Free and Rosie Plus.
- Rosie Grand Cru is a complimentary, invitation-only plan with the same features as Rosie Plus. It can't be bought. We may give it for a set time or withdraw it at any time; you then go back to Rosie Plus (if you subscribe) or Rosie Free, and keep your account and history. Grand Cru never cancels or replaces a paid subscription; manage that with Apple or Google.
- We may change the free allowance or fair-use limits. We won't reduce scans already given to you for the current period, and we'll tell you in advance in the app about changes that affect you.
6. Subscriptions, billing and cancellation
- Rosie Plus is sold through the App Store on iPhone and Google Play on Android. Apple or Google takes payment, and its terms apply to the purchase. The price, in your currency and including any applicable taxes, is shown before you buy.
- There is no free trial: billing starts when you subscribe.
- Your subscription (monthly or yearly) renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends.
- To cancel: on iPhone, go to Settings → [your name] → Subscriptions; on Android, open the Play Store → your profile → Payments & subscriptions → Subscriptions. You keep Rosie Plus until the end of the period you've paid for. Deleting the app or your Rosie account does not cancel the subscription.
- Refunds are handled by the store you bought from, under its policies: Apple (reportaproblem.apple.com) or Google Play (play.google.com, Order history). If you're a consumer in the EU or UK, you may have a right to withdraw from the purchase within 14 days; the store handles this as the seller.
- If we raise the price of Rosie Plus, Apple or Google will tell you in advance and, where required, ask for your agreement. If you don't agree, the subscription won't renew.
- Use "Restore purchases" in the app to get Rosie Plus back on a new device.
7. Using Rosie fairly
Rosie is for your personal, non-commercial use. Please don't:
- use automated tools, scripts or modified apps to access Rosie, or try to get around its limits, security or integrity checks;
- copy, scrape, resell or build a database from Rosie's content, recommendations or the wine data behind it;
- reverse-engineer the app or our service, except where the law allows it;
- use Rosie to send anything unlawful, harmful or unrelated to wine, or try to make Rosie produce such content;
- photograph people or private documents instead of a wine list;
- use Rosie to break any law, including rules on alcohol.
Fair use. "Unlimited" scans on Rosie Plus and Rosie Grand Cru means as many as a person reasonably needs when eating or drinking out. To protect the service, we apply daily and monthly limits well above normal use. If you reach one, Rosie will tell you when you can scan again.
8. What you send us
- You keep any rights you have in what you send (photos, answers, questions). You give us permission to use it to run Rosie for you, as described in the Privacy Policy.
- Wine-list information we read (wine names, prices, sections, restaurant name) isn't about you. You agree that we may keep and use it, without your details, to improve Rosie.
- If you send us ideas or feedback, we may use them freely, without owing you anything.
9. Our content and the app licence
Rosie, including its design, illustrations, text, wine profiles and the software, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, under these terms and, if you downloaded it from the App Store, Apple's standard Licensed Application End User License Agreement. The Rosie name and logo are ours; please don't use them without permission.
10. Other companies' services
Rosie relies on services from other companies, including Apple, Google and OpenAI. Their terms may also apply to you (for example Apple's or Google's for purchases and sign-in). We aren't responsible for their services or for restaurants' lists, prices and service.
11. Changes to Rosie and to these terms
- We keep improving Rosie and may add, change or remove features. If we remove something important that you've paid for, we'll tell you in advance and you can cancel.
- We may update these terms, for example when Rosie or the law changes. For significant changes, we'll tell you in the app at least 30 days before they take effect. If you don't agree, you can stop using Rosie and delete your account; continuing to use it after that date means you accept the new terms.
12. Ending your use of Rosie
- You can stop using Rosie and delete your account at any time.
- We may suspend or close your account if you seriously or repeatedly break these terms, if you aren't of legal drinking age, or if the law requires it. Where reasonable, we'll warn you first and explain why. If we close your account without good reason while you have a paid subscription, you're entitled to a fair refund for the unused period.
- We may stop offering Rosie altogether. We'll give you reasonable notice, at least 30 days where possible.
13. Our responsibility to you
- We'll provide Rosie with reasonable care and skill. Apart from that, and to the extent the law allows, Rosie is provided "as is": we don't promise it will always be available, error-free, or that its suggestions or information will be accurate or suit you.
- We aren't responsible for: what you order, drink or pay at a restaurant; decisions you make based on Rosie's suggestions; mistakes in reading a list; or losses we couldn't reasonably foresee.
- Where the law allows a limit, our total liability to you is limited to the greater of what you paid us for Rosie in the 12 months before the claim and 50 euros (or the equivalent in your currency).
- Nothing in these terms limits rights you have as a consumer that can't be excluded, such as under the consumer laws of the EU, UK, France, Australia (including the Australian Consumer Law guarantees), Canada or US states. Nor does it limit our liability for death or personal injury caused by our negligence, fraud, or anything else that can't be limited by law.
14. Law and disputes
- If something goes wrong, please contact us first at hello@askrosie.app. Most problems can be sorted out quickly.
- These terms are governed by the laws of the State of Wyoming, USA. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there.
- Rosie Plus is bought from Apple or Google, which handle payment questions and refunds (reportaproblem.apple.com, or Order history in Google Play). You can also contact your local consumer authority; in France, for example, through SignalConso (signal.conso.gouv.fr).
15. Apple and Google
If you got Rosie from Google Play, Google's terms for Play apply alongside these, and Google isn't responsible for Rosie. If you got it from the App Store: these terms are between you and us, not Apple. Apple isn't responsible for Rosie or its content, has no obligation to provide maintenance or support for it, and isn't responsible for any claims relating to Rosie (including product liability, legal or regulatory compliance, consumer protection or intellectual property claims); we are, as set out in these terms. If Rosie fails to meet a warranty that applies, you may notify Apple, which will refund the purchase price (if any) to you; to the extent the law allows, Apple has no other warranty obligation. You confirm that you aren't located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country, and aren't on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
16. General
- These terms, together with the Privacy Policy, are the whole agreement between us about Rosie.
- If a court finds part of these terms invalid, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- We may transfer this agreement to another company as part of a sale or reorganisation of our business; your rights won't be reduced. You may not transfer your account.
- These terms are available in English, French, Spanish and German. If they differ, the version in your language applies.
